Medical Attorneys
By Dave Austin of Burke-Eisner
Medical attorneys are legal professionals who help victims of medical malpractice in seeking compensations for injuries (monetary or non-monetary) that they have suffered. Every case of medical negligence is unique and needs thorough evaluation to determine eligibility. Factors governing the amount of compensation are: •Extent of injury •Total cost of treating the injury •Injury caused permanent disability to the victim •Injury resulted to death of the victim Medical attorneys are highly-trained people who know the special rules and exceptions imposed by different states for medical malpractice cases. Most states have special rules on the statute of incapacity. There are instances that state laws governing time limitations will only start running when the victim discovers about the malpractice deed (i.e. ‘surgical instruments or foreign objects’ cases). ‘Wrongful death’ statutes exist in New York and Massachusetts. Common types of medical malpractice include: errors during labor and child delivery, surgical mistakes, errors in medication, and misdiagnosis. The consequences of whatever type of malpractice are always potentially harmful and fatal to victims. Even if you were asked to sign a consent form, your rights have not been waived. The consent you’ve given is just an acknowledgment of the risks and complications in connection with a particular treatment or surgery. Your signature does not relieve the health care professionals from their obligation—meet the standard code of health care. People in the medical profession do not have the right to neglect their patients at all times. If you or your loved ones were a victim of medical negligence, you must talk to medical attorneys as soon as you can. Attempting to represent yourself will only waste a your time and may cause you the only chance to fight for your rights. Seeking the counsel of experienced legal professionals will give you several legal options. Your best interest shall always be the first priority. Even though a case does not have an unfortunate outcome, the victim should come forward and claim his right. Medical attorneys will evaluate your case. They have enough experience and knowledge about various state and federal laws that provide opportunities for victims to seek compensation for their losses: •Non-monetary losses – loss of loved one, loss of companionship, physical pain, emotional suffering, and mental anguish •Monetary losses – expenses caused by physical injuries, incurred for treatment, rehabilitation, loss of employment, and income opportunities
