Medical Attorney

When you or your loved ones had suffered from injuries or damages caused by medical malpractice, consulting with a medical attorney is the best decision for you to make.

Why do you need a medical attorney?

The laws governing medical malpractice cases vary from state to state. The whole process of filing a medical lawsuit is very complicated, risky, and expensive—from start to finish.

During evaluation of the case, medical records and relevant materials must be accessed; as well as testimonies of medical experts. The main goal is to prove that the health care provider and/or health care institution had been negligent.

Next factor is the amount of medical compensation for damage or injury inflicted to the victim.

Every case is uniquely different and must be approached afresh to remain objective.

For example, two 35-year old men with same injury on their right hands due to surgical errors may not be able to receive similar amount of monetary compensation. The computation may be based on their occupations and income. If one was a right-handed art painter and the other was a construction worker, the former may be able to command a claim higher than the latter’s.

Another factor is the identity of the defendant(s). Filing a medical malpractice case is time-consuming and costly so making sure that the defendant would afford to pay any legal claim. Since most of the medical professionals and medical institutions are insured, this is not a major problem.

You must carefully choose the medical attorney because expertise is important. He or she must be qualified and committed on helping victims seek justice.

Legal actions in this area are often extremely difficult to pursue because insurance companies that handle the claims of physicians and hospitals are typically aggressive on defending all legal claims against the medical entities that they insure.

Each year in the United States, deaths caused by medical malpractice has grown to about 100,000. About several thousand cases suffer from serious damages. Only a small percentage or less than 15 percent of victims consult a medical attorney to seek help in fighting for their legal rights.
